Basic principles of parental responsibility

The child before reaching 18 years old according to the laws of the Russian Federation is obliged to be under the control of its parents. Even in the Constitution it is indicated that all questions about education and care for children belong to their parents - and this is not only their right, but also the duty. Such an approval of all-friendly education implies all kinds of assistance to a child and a care:

  • in physical plane and material needs;
  • in educational process, learning, development;
  • in psycho-emotional plan: to establish as a person with the help of parents.

It is spelled out in the Family Code, and more specifically in Articles 63-65. The responsibility of parents for the upbringing of children is divided into several varieties depending on the cause of damage to the child:

  • the non-fulfillment of parental duties is an intentional refusal to take care of the child (there is a lot of examples when a woman throws the fate of a newborn, without informing anyone about his criminal decision, or forgets the child on the street, among the neighbors, familiar);
  • inappropriate performance of their duties, as a parent (inaction, illegal actions towards a child). In connection with these two types of violations of the Parent Liability Act for the upbringing of children, the existing legislation of the country distinguishes such types of responsibility:

  1. Criminal legal (which is described in detail in Article 156 of the Criminal Code of the Russian Federation).
  2. Administrative and legal (CACAP, Article 5.35).
  3. Civil law.
  4. Responsibility for the Family Code.
